R7 on my credit report, placed there at the wrong time, what are my rights?
Back in 2005 I foolishly hired a debt consolidation company to help pay off my debts. One of those places like you see on TV that says they'll negotiate with your creditors and reduce your payments. IF YOU CAN PAY IT YOURSELF THEN FOR GODS SAKE DO IT, DON'T HIRE THOSE IDIOTS, THEY DON'T TELL YOU HOW MUCH DAMAGE THEY'RE GOING TO DO TO YOUR CREDIT. Well anyway I ended up paying off my debts ahead of schedule in 2008 and gave the "credit rebuilders" the boot. But since I didn't do it by their payment program, and because they were too lazy to actually ask my creditors if the debts were paid, they sent letters to each creditor saying that I had failed their program and the accounts wouldn't be paid. BMO got such a letter and without even checking their own records to see if it was true, they referred my name to collections. So like 6 months after I paid them, I get a collection call and boy their faces must have been red when they realized they wasted the effort. Nonetheless they apparently placed an R7 on my credit report. Now I realize they were within their rights to place that there.....in 2005 when the debt consolidation actually occurred. And that if they had then that R7 would still be there today. But they didn't do it in 2005, they did it in 2009, 6 months after the account was paid. And because they did that it looks like recent activity, not the 6 year old activity it actually was. And now that little technicality is holding up my mortgage. I'm going to speak to BMO on Monday and ask them nicely to either remove it or give me a letter confirming the correct date it should have been placed. If they do then great, but if they decide to be spiteful with me and say they aren't obligated to do anything what is my best argument? I'm pretty sure that information reported to the credit bureau is required to be accurate am I right? Are there any penalties for them if they refuse to set it straight? Thanks for any help.
